Mary Carignan v. New Hampshire International Speedway, et al

Mary Carignan was a passenger on her husband Dennis’ motorcycle as they headed south on Route 106 in Loudon to meet friends for breakfast. As they drove past the New Hampshire International Speedway, a Winnebago towing a pick-up truck pulled out in front of them and proceeded slowly. Dennis Carignan put on his directional and pulled out to pass the Winnebago. When the Carignan motorcycle was alongside the Winnebago, its directional came on and it began turning left into the path of the motorcycle. At the same time, Speedway personnel were standing at the south entrance waiving in the Winnebago. Dennis laid the motorcycle down to avoid a collision. Mary was ejected from the motorcycle and suffered a fractured hip that ultimately required replacement surgery.


Matt brought suit on behalf of Mary Carignan against the Winnebago operator and the Speedway. Prior to trial, the total settlement offer from the insurance companies was $25,000.00. After a one week trial, a Belknap County Superior Court jury returned a verdict of $1.2 million. This was the second largest jury verdict in the history of Belknap County Superior Court.


Matt successfully argued the case before the New Hampshire Supreme Court twice to preserve the verdict.

Wrongful Death

A man and his wife were traveling across New Hampshire to visit family in Massachusetts. On the way, a lumber truck making a delivery crossed the double yellow line and struck their vehicle head-on. The man was killed on impact. Matt filed a wrongful death action on behalf of the estate against the lumber company. The case settled before trial for a confidential amount.


Medical Negligence

An elderly woman was admitted to a hospital for a colonoscopy under sedation. After the procedure, the woman was left alone by hospital staff and fell, fracturing her hip. Hip replacement surgery followed. Matt filed a medical negligence action against the hospital. The case settled prior to trial for a confidential amount.


An elderly woman in a county nursing home fell from her wheel chair while being transported by staff. She suffered a hip fracture. Matt filed a medical negligence action against the nursing home. The case settled prior to trial for $150,000.


Motor Vehicle

Settlement of $575,000 for a young man who suffered significant back injuries in a motor vehicle accident on I-95 in Massachusetts. The man also received a $75,000 workers compensation settlement as he was working at the time of the accident.


Settlement of $250,000 for woman involved in motor vehicle accident while working. She also received a $50,000 workers compensation claim settlement.


Settlement of $200,000 for an elderly woman involved in a motor vehicle accident who suffered an ankle injury that required surgery.


Settlement of $150,000 for a motor vehicle accident involving two men; the driver swerved to avoid a deer and hit a tree, injuring the passenger.


Settlement of $137,000 for woman who sustained injury in Arkansas as the result of items falling from a truck in front of her that struck her vehicle.


Settlement of $115,000 for a passenger injured in a motor vehicle accident where the driver was impaired by alcohol.


Settlement of $100,000 for a woman who was struck by a motor vehicle while crossing a street and suffered significant shoulder injuries.


Settlement of $100,000 for a woman who suffered significant neck injuries in a motor vehicle accident.


Settlement of $100,000 for a woman involved in a motor vehicle accident in Florida who suffered a significant knee injury.


Settlement of $100,000 for a woman involved in a rear-end motor vehicle accident who suffered neck and back injuries.


Settlement of $60,000 for a young man who was struck by a motor vehicle while crossing a street in Vancouver, British Columbia and suffered shoulder and knee injuries.


Premises Liability/Slip & Fall

Settlement of $400,000 for a man who suffered serious leg injuries while attempting to remove a dangerous limb above his mobile home. The park owner had refused to remove the limb, though asked repeatedly to do so. Matt brought a negligent action on behalf of the man claiming that the park owner had a duty to remove the dangerous limb. The case settled prior to trial.


Settlement of $325,000 for a woman who suffered multiple arm fractures when a stair railing broke while exiting a building.


Settlement of $250,000 for a man slipping and falling on ice while entering a convenience store and suffering a back injury.


Settlement of $165,000 for a man who tripped and fell an unguarded step-up in a store and suffered knee and shoulder injuries.


Settlement of $150,000 for a woman who slipped and fell on a wet floor in a department store bathroom and suffered neck and back injuries.


Settlement of $115,000 for a delivery man who slipped and fell on an icy step at a customer’s store.


Jury verdict of $100,000 to woman falling backwards down the stairs when door handle fell off in her hands.


Settlement of $50,000 for a man who suffered knee injuries when a deck he was on collapsed.



Civil Rights


Matt represented a man and a woman and their 15 year old daughter for claims of excessive force against a SWAT team that conducted a raid on their apartment. The SWAT was there to arrest the couple’s 17 year old son. Clients claimed that the officers pointed assault rifles at their heads after they were subdued and forcefully pushed the 15 year daughter to the floor, injuring her knee. A 1983 civil rights action was filed in the Federal District Court. The district court denied the officers’ motion to dismiss the case and the officers appealed to the First Circuit Court of Appeals in Boston. After briefing and argument, the appeals court upheld the clients’ right to maintain the suit. Thereafter the case settled for a confidential amount.
